Texhoma Coach Pleads Not Guilty

The Texhoma coach who is accused of having sex with one of his students while he was a teacher in Hennessey, Okla. has plead not guilty to two counts of second-degree rape.
Ben Davis Forsythe, 32, now the girl’s basketball coach at Texhoma High School, is accused of having an affair with a student while he worked in Hennessey.
Forsythe was arrested in December on the Texhoma School grounds for two counts of second-degree rape. The affidavit says he had an affair with a student from November 2009 until May 2010.
According to KOCO, Forsythe’s attorney says Forsythe feels like he’s being accused of something he didn’t do. His attorney also said he plans to file a motion soon about the Constitutionality of the case. That’s because the girl he’s accused of having sex with was 18-years-old, the attorney said.
Regardless of age, Oklahoma statutes say a teacher is not allowed to have sex with a student, no matter the age and if it was consentual.
Forysthe remains employed by Texhoma High School as a teacher and coach.
Jury trial is set to begin May 11.
