Kansas Supreme Court to Hear Seward County Case

Joe Denoyer - January 24, 2023 4:34 pm

The Kansas Supreme Court will hear a case out of Seward County at 9 a.m. on Tuesday, January 31. This case is Appeal No. 123,382: State of Kansas v. Allen Lee Busch

Seward County: (Petition for Review) Allen Lee Busch pled guilty to one count of possession of methamphetamine in December 2019. At sentencing, Busch agreed with the district court’s finding that he had a criminal history score of A. The district court sentenced Busch to probation, but probation was revoked and the district court ordered Busch to serve his underlying 40-month prison sentence. The Court of Appeals held the district court’s decision was the most appropriate outcome in this matter. The issue on review is whether Busch is serving an illegal sentence scoring his prior convictions as person felonies based on a notation on the presentence investigation report that showed “residential.”

This case will be heard in the Supreme Court courtroom on the third floor of the Kansas Judicial Center in Topeka. All Supreme Court oral arguments are also broadcast live over the internet. To access proceedings live online, go to www.youtube.com/kansassupremecourt.
