Kilbourne Makes Court Appearence: UPDATE

UPDATE: It didn’t take long. Prosecutors say the encounter between Jan Kilbourne and Butler County Sheriff’s Deputy Jacob Lawrence in early September lasted only minutes.

In the end, Lawrence was shot and Kilbourne was the suspect and the focus of a massive manhunt.

Kilbourne will now stand trial for attempted capital murder.

"We have a very, very straightforward case," says prosecutor Darrin Devinney. "We have laid it all out and are ready to proceed."

Kilbourne is facing charges of attempted capital murder, a felon in possession of a firearm and interfering with a law officer.

Lawrence was wearing a bulletproof vest at the time of the encounter with Kilbourne. The deputy suffered a relatively minor wound and was in the courtroom Friday, talking about the case.

After just a few hours, Judge David Ricke declared the case has enough evidence to go to trial.

"The court finds at this time, in regards to the charge of attempted capital murder, that the evidence stated and presented today shows that the defendant, Jan Tracy Kilbourne, intentionally attempted to kill Jacob Lawrence,” said Ricke.

Preliminary motions are set for December 9 and the trial will be December 13.

Kilbourne remains in custody on $1 million bond.

The man accused of shooting a Butler County sheriff’s deputy early last month is in court today for a preliminary hearing.

Jan Tracy Kilbourne, 41, is accused of shooting a deputy during a routine traffic stop in the early morning hours of Monday, September 2.

The deputy had just collected information from the driver and had gone back to his patrol car when one of the passengers got out and began shooting. The deputy was hit in the shoulder, and returned fire.

Law enforcement officers searched for Kilbourne for several days, until he was arrested four days later in Wichita.

He was charged with attempted capital murder, criminal possession of a firearm by a felon and interference with law enforcement.
