Arrest Made In Guymon After Brawl At A Club

KSCB News - January 29, 2013 11:22 am

An early Sunday morning brawl right around closing time at Club Venue ended with the arrest of 30-year-old Yoel Marquez Oliva for Obstructing an Officer and Public Intoxication.
Around 1:51 a.m. Officer Jacob Bankston was dispatched to Club Venue for a report of a large fight in progress, according to the Affidavit of Probably Cause. Lt. Arndt and Texas County Deputy Halliburton also arrived on scene.
Arndt advised Bankston that he made contact with a bouncer at the club who stated that two hispanics had been involved in a fight with him and that he was struck in the back of the head with a beer bottle, or something of the sort.
Arndt and Halliburton were given the direction that one subject had taken off on foot, and after a chase around the building and through a vacant lot, the subject, later identified as Yoel Oliva, continued to ignore the commands given by Arndt to stop, resulting in Arndt deploying K9 Caro due to the possibility of Oliva being armed. Oliva continued to run down an alley and then south on Elm St. and then West on N.E. 4th.
Officers Gilkey and Bankston were in pursuit in their patrol units down N.E. 4th St. and they were able to handcuff Oliva after turning on East St. and ordered him to stop and got him on the ground at gunpoint, at which time Bankston was able to detect alcohol on on Oliva’s breath.
Bankston and Gilkey returned to Club Venue where Bankston identified an individual, Hector Hernandez, sitting in a vehicle with blood on his face and head and he was taken to the hospital by an unknown female.
Hernandez had a laceration of approximately four inches long on the back of the head and another laceration approximately one inch on the right cheek of Hernandez’s face which he obtained while trying to assist the bouncer in breaking up the fight when he was hit with a beer bottle, but was unable to identify who did it.
The bouncer from Club Venue filled out a voluntary statement that stated that Oliva attacked Hernandez with the beer bottle, and Hernandez stated that he did not want to file charges, according to the affidavit.
Arndt was able to locate the neck of a broken bottle at Club Venue with what appeared to be blood on it, and was able to locate small drops of what appeared to be blood in the parking lot.
Oliva was transported and booked into the Texas County Jail with the charges of Obstructing and Officer and Public Intoxication.
